Retail - Terms and Conditions of using Al Ahly Net and NBE Mobile services

Upon signing this application, the Customer has the right to use Al Ahly Net and NBE Mobile services provided by the National Bank of Egypt, under the terms and conditions mentioned below; the Service terms and conditions available online/ via mobile phone; the provisions, terms and conditions mentioned in the Account Opening Form and Credit Card Issuance Application; as well as the conditions of NBE's banking products and services, as amended, which the Customer subscribed to with the Bank. Those terms and conditions shall also remain valid and applicable to all operations and the Customer's relationship with the Bank.

Article (1): Definitions

The below words and expressions mentioned in the terms and conditions shall herein mean the following:

·          "The Bank" means National Bank of Egypt (NBE) (S.A.E.)

·          "The Customer" means NBE card/ account holder.

·          "Confidential Data" means all data related to activating and using Al Ahly Net and NBE Mobile services, including but not limited to user ID, password and/or Customer data and accounts.

·          "Hard Token" is a device used to generate one-time password (OTP) held by the Customer.

·          "Soft Token" is an application used on the mobile phone to generate OTP and can be downloaded via App store/ Google Play.

·          Self-registration: is a service that enables customers to subscribe to Al Ahly Net/ NBE Mobile service and directly set the user ID and passcode online via Al Ahly Net/ NBE Mobile service website.

·          "Biometric authentication" means the feature of logging into NBE Mobile App via mobile phones and tablet devices using fingerprint or facial recognition features.

·          One Time Password "OTP" is a code generated through hard/ soft token or it is sent by NBE for one-time usage to verify the Customer's identity.

Article (2): Service Provision Mechanism

·          Al Ahly Net/ NBE Mobile Service provides the Customer with certain online banking services, including but not limited to account opening; purchasing/ redeeming certificates, booking/ canceling term deposits; statements of account review; effecting credit card payment; and making customer’s own account transfers and domestic transfers in local currency inside the Arab Republic of Egypt. This is in addition to the services to be provided by the Bank from time to time.

·          Upon signing the subscription application to Al Ahly Net and NBE Mobile services online and via mobile phone, and completing the procedures by the Customer, following verifying the Customer's identity by the Bank, the Bank will create the Customer's user ID to be forwarded to the e-mail registered at the Bank; and the Customer will receive Login Passcode on his/her mobile phone registered at the Bank.

·          The Customer shall access internet banking services via NBE's website or NBE Mobile App and enter the user ID and the Login Passcode, and after verifying the entered information on the system, the Customer is directed to create new Login Password.

·          In case the Customer loses the login password, the Customer can reset the Login Password by taping "Forgot Password" and entering the national ID number. The Customer shall review the last three digits of his/her mobile phone number registered at the Bank then approve that the mobile phone number is true and correct. The Bank will send the OTP to the Customer's mobile phone and e-mail registered at the Bank to be used by the Customer and the system will verify his/her identity. The system allows the Customer to create a new password. In case the Customer fails to enter any such information, the Customer must visit the branch or contact 19623 to receive new login passcode on the Customer's mobile phone number registered at the Bank. Afterwards, the Customer enters the login passcode to the system, and after being verified by the system, the Customer is directed to create a new login password.

·          Al Ahly Net/ NBE Mobile service enables the Customer to use self-registration via NBE's official website. The customer shall create the user ID and passcode after the system identifies that the entered information is true and correct, and identical to those registered at the Bank, account status and the OTP sent to the mobile phone number and e-mail registered at the Bank. Such information shall be deemed confidential and may not be disclosed to any person. The Customer shall be solely responsible for keeping the confidentiality of such information without any liability on the Bank.

Article (2.1): Customer's subscription to Al Ahly Net / NBE Mobile service to make financial transactions

·          If the Customer has been a subscriber to Al Ahly Net/ NBE mobile previous services (only inquiry – own account transfers), the Customer's subscription shall be automatically updated to include internal and domestic financial transactions, making payments and many other financial services.

·          Al-Ahly Net / NBE Mobile service allows “automatically” to show all accounts / cards / loans / certificates / term deposits / mutual fund (existing / new) related to customer and it will not be possible neither to limit dealing through the Al-Ahly Net / NBE Mobile service to “Specific” accounts / cards / loans / certificates / Term Deposits / mutual fund, nor dealing with service will be inquiry only”.

·          If the Customer wishes to make internal or domestic financial transactions, a Hard Token shall be obtained from the nearest NBE branch or the Soft Token application shall be downloaded on the Customer's mobile phone. The hard/ soft token generates an OTP to be entered by the Customer to process any internal or domestic transaction.

·          The Customer shall create a PIN upon using hard/ soft token for the first time.

·          Hard Token is a personal device that may not be returned or reassigned, and the applicable charges shall be collected once received from the branch. The Customer may use the Soft Token with no need to receive the Hard Token from the branch or use both according to customer request.

·          The Customer shall activate the Hard Token by contacting 19623 to verify the Customer's identity, thereby activating the hard token. Service subscription and activating Soft Token application can be directly made using Al Ahly Net/ NBE Mobile service.

·          In case the hard token is lost or stolen, the Customer shall contact at 19623. The Customer Service representative shall deactivate the hard token. The Bank shall bear responsibility as of the deactivation date only. The Bank shall not be deemed liable for any transactions/ losses resulting from using the Hard Token before the deactivation date. If the Customer requests a new device, the necessary relevant fees are charged.

Article (3): Financial transactions

·          The Customer undertakes not to make any financial transactions, instructions, operations and/or requests of a value exceeding the Customer's account balance. If so, the Bank will promptly decline the transfers, instructions, operations or requests without any notification.

·          All financial transactions, instructions, operations or requests made by the Customer will be processed according to the exchange rates, interest rates and mutual fund certificate prices prevailing and applicable in the Bank on the actual execution date as per the cutoff time specified by the Bank.

·          In case of placing standing instructions, the Customer shall have a sufficient balance to execute the standing instructions on the specified dates.

·          Fees and commissions applicable by the Bank on financial and non-financial transactions made via Al Ahly Net and NBE Mobile service shall be debited according to the banking tariff.

·          Customer's request shall not be satisfied in case the account balance is insufficient to execute the transfer to a beneficiary with NBE or with another bank on the date of transfer execution.

·          The Customer shall be held liable for all the transactions executed via the Service and the payment of any amounts due to the Bank resulting from that usage.

·          The Customer declares that s/he shall be solely liable for the correctness of information related to money transfers, including but not limited to beneficiary's name and account number, amount, bank and branch name, etc. without the least liability on the Bank.

·          The Customer shall comply with all the rules and regulations issued by the Central Bank of Egypt (CBE) regarding banking transfers.

·          Financial transaction limits available for customers via Al Ahly Net/ NBE Mobile shall be determined according to the customer classifications based on the total account balance. The Customer may review these limits on Al Ahly Net and NBE Mobile.

·          The Bank shall have the right to change the daily or monthly maximum limit or financial transaction limits processed via Al Ahly Net / NBE Mobile service with notifying the Customer by any means the Bank deems appropriate.

 

Article (4): Bill payment

·          The Customer shall keep sufficient account balance to pay any bills on the due dates. The Bank shall not be held liable for non-payment of any bills on their due dates because of insufficient balance in the Customer's account. The Customer shall be solely responsible for any relevant interests and/or default interest resulting from delayed payment.

·          The Customer declares that s/he shall be solely responsible for the correctness of the data related to the bill payment, including but not limited to phone number, amount, bill number, etc., without any responsibility on NBE. The Customer shall bear all the ensuing consequences as the Bank shall not verify such information.

Article (5): Service charges

·          The Customer shall bear the charges (for subscription as well as banking commissions resulting from using different electronic banking services) as specified and announced by the Bank from time to time. In case the Customer requests to obtain the Hard Token, the charges of the Hard Token shall be collected. The Bank reserves the right to amend such charges, and the Bank shall notify the Customer thereof by the means deemed appropriate by the Bank. Therefore, the Customer does hereby authorize the Bank to debit the due charges to the Customer's account(s) held with the Bank.

Article (6): Service availability

·          In case the Service stops because of the disruption of the systems operated by the Bank or any specialized entities outsourced by the Bank, the Bank shall undertake due care to restore the Service within 4 hours. Otherwise, the Bank shall notify customers, by the means deemed appropriate by the Bank, of the date by which the Service is expected to be restored.

·          The Bank shall, from time to time, have the right to modify, maintain, and/or update Al Ahly Net/ NBE Mobile services, which may result in suspending the Service for a certain period set by the Bank. This shall be deemed one case in which the Bank shall not be liable for the Customer’s failure to use the electronic banking services and the Customer shall have no recourse against the Bank for any claims during that period, provided that the modification, maintenance and/or update shall be announced on the Service website.

·          The Bank shall bear no responsibility for any malfunction of Al Ahly Net and NBE Mobile services for any reason/event that is beyond its control and without any violation or negligence on its part; neither shall it be responsible for any malfunctions in the communication means, any computer virus and/or any related problem.

Article (7): Responsibilities and Liabilities

·          The Bank undertakes to treat as confidential all the data and information that might be received from the Customer to deliver Al Ahly Net/ NBE Mobile services. The Bank also undertakes to maintain the confidentiality of all the Customer’s transactions made via the Service. The Bank undertakes not to disclose any of the above-mentioned information or transactions unless required by the applicable laws of the Arab Republic of Egypt and/or in execution of any binding judgments or orders or as per the Terms and Conditions of Al Ahly Net/ NBE Mobile service.

·          The Customer declares that s/he accepts the full and complete responsibility for keeping the confidential data, taking all necessary relevant actions and not disclosing such data to any person or an employee of the Bank or any other entity.

·          The Customer declares that when s/he becomes aware of the fact that any account is subject to theft, misappropriation or manipulation; any transactions are deducted without permission from the Customer; or the Customer's confidential data become known by another person, then the Customer shall instantly inform and request the Bank to suspend Al Ahly Net/ NBE Mobile services so that the Bank can take necessary action. In case of the Customer's failure, the Customer shall be responsible for any transactions/ operations performed on his/her account without notification. The Customer shall be liable for all instructions performed by the Bank based on a request or inquiry made by any person unauthorized to use the Customer's confidential data. The Bank shall not be held liable for any claim, loss, late charges or expenses resulting from such instructions.

·          In case that the Customer's mobile phone is lost or stolen, the Customer shall promptly notify the Bank to suspend Al Ahly Net/ NBE Mobile/ Soft Token services.

·          The Customer declares to be solely responsible for protecting his/ her relevant mobile phone and the Bank will not be responsible for disclosing any data/ information sent to the Customer's mobile phone.

·          The Customer shall review the warnings and alerts published on the website of Al Ahly Net/ NBE Mobile services. The Customer shall comply with all terms and conditions displayed via the website of Al Ahly Net/ NBE Mobile services, which are deemed legally binding upon the Customer.

·          The Customer shall review and follow the security recommendations and instructions published on the electronic channels or NBE's official website.

·          The Customer undertakes to comply with all security standards in addition to any other instructions issued by the Bank. The Customer agrees to read and review such standards and instructions periodically. The Customer shall be responsible for ensuring the security level of the devises used for access to the Bank's electronic Services.

·          The Customer hereby expressly declares the complete authenticity of the Bank's automated outputs evidencing the banking instructions/ operations based on the Service provided to the Customer.

·          The Customer shall be solely responsible for protecting and using his/ her mobile phone/ tablet devices in case of activating the "Biometric Authentication" feature to be used as a means of identity verification upon logging into NBE Mobile service.

·          The Customer shall be solely responsible for the information entered for self-registration and the Bank shall bear no liability for disclosing the entered information or OTP sent to the mobile phone/ e-mail registered at the Bank as such information is confidential and may not be disclosed to any other person.

·          The Customer shall notify the Bank in writing promptly upon the occurrence of any change in the data related to his/ her legal status. If the Customer fails to give such notification, s/he shall bear the full legal liability and the consequential damages. Moreover, banking transactions executed without notifying the Bank in writing shall be deemed valid, and the Customer shall solely be fully liable for such transactions.

·          The Customer shall use the services contemplated hereunder in legal transactions which neither conflict with the Egyptian laws nor prejudice the State's interests or national security of the Arab Republic of Egypt.

·          The Customer shall update his/her information, including but not limited to mobile phone number and/ or e-mail.

·          The Customer guarantees that the use of services contemplated hereunder shall not violate or breach the legal rights of any third party.

·          The Bank shall notify the Customer of any high-risk financial transactions or activities made through the account – unless the Customer requests otherwise – via SMS or e-mail.

Article (8): Disclaimer

·          The Bank or other specialized entities contracted by the Bank shall not be held liable for any damages resulting from delay in sending and transferring the information, failure or error in receiving the information, loss of information, uncontrollable malfunction, emergencies (e.g. shortage, business interruption, strikes, force majeure, natural disasters, security gaps), measures taken by the State authorities, or any other events. The Bank shall not either be liable for any damages to the Customer, technology or electronic equipment due to any of the foregoing events as long as there is no violation or negligence by the Bank.

·          The Bank shall take due diligence to provide Al Ahly Net/ NBE Mobile services and shall not be held liable for any failure in providing the service partially or wholly due to any reason beyond the Bank's control. The Bank does not provide any commitments or guarantees regarding, for instance, quality, speed, accuracy, etc. The Bank shall not guarantee that the programs are free of errors or deficiencies and shall handle any resulting negative effects on the banking operations. The Customer acknowledges that the Bank is not held liable for the foregoing unless the Bank commits a violation or negligence.

·          The Customer declares that his/her mobile phone, user ID, login password, and the Hard Token, when received from the Bank, or the Soft Token activated on the Customer's mobile phone, and the login feature using a biometric authentication like facial recognition/ fingerprint, if activated by the Customer, are all means of identification and that any transactions executed using such means shall be deemed to be the Customer's instructions since such means constitute As a method of confirming/validating customer's identity. The Bank shall consider any person using such means to be the Customer. The Customer shall be held liable for all transactions executed using his/her respective means of identification as well as for any change, loss or transfer of such means of identification to a third party until the Bank is able to suspend the service at the request of the Customer. Since such services are provided over the internet and/or mobile phone, the Bank shall not be liable for jeopardizing the account confidentiality as a result of any misuse made by the Customer or due to electronic hacking.

·        The Bank shall be entitled to add new electronic banking services; or amend or cancel the existing services at its sole discretion, with a notification served by the Bank to the Customer in the manner deemed appropriate for the Bank.

·          The Customer declares to be solely responsible for keeping the confidentiality of OTP to be sent to the Customer's mobile phone or e-mail, or generated by the Hard Token or the Soft Token upon performing Al Ahly Net and NBE Mobile services.

·          As for using Biometric Authentication including fingerprint or facial recognition features or any other means of Biometric Authentication, the Bank shall activate them in the future to enable logging into the service via NBE Mobile, using all Biometric Authentication features defined on the mobile phone/ the tablet device. The Customer shall bear full responsibility without any least liability on the Bank.

·          The Customer shall carefully read and approve Biometric Authentication Terms & Conditions before activating and using the biometric authentication features as a means to identify the Customer logging into NBE Mobile App. The Customer's electronic approval to activate a feature via the mobile phone/ tablet device, and use of its advantages, shall be deemed a full approval of the outlined terms and conditions and an undertaking not to breach such terms and conditions.

Article (9): Intellectual Property Rights (IPR) and Copyright

·          The logo of the National Bank of Egypt is a trademark owned and registered by the Bank. The National Bank of Egypt has the right to acquire possession of any trademarks of its products/ services.

·          The Customer acknowledges and agrees that he/she does not, and shall not, have any copyright or other IPRs in any of the programs, interfaces or documents provided by the Bank to offer or improve electronic banking services. The Customer shall not, and will not allow other persons to, copy or modify any of such programs, interfaces or documents provided by the Bank; or upload or migrate the electronic banking service programs from/to any other computer, phone, tablet or any other similar electronic device. In case the Customer breaches the foregoing or is not able to secure such programs and documents provided by the Bank as a service to the Customer, the Bank shall have the right to claim from the Customer all necessary indemnities for the damages sustained by the Bank.

·          Copyright of images, graphics, information, marks, texts, publicity materials, interfaces and webpages, including the site page design, are property of the Bank and/or any other party referred to in the website pages and may not be utilized for any personal or commercial purposes.

Article (10): Service Termination

·          In case the Customer wishes to suspend Al Ahly Net/ NBE Mobile services, the Customer shall contact at 19623 or visit the nearest NBE branch. In order for the Customer to reactivate the Service, the Customer shall visit the nearest NBE branch to fill in the Service Reactivation Application affixed with a verified signature of the Customer.

·          The Bank may terminate the Customer’s subscription to the said services at anytime with notifying the Customer if possible. Such termination shall not exempt the Customer from any obligations with respect to the electronic banking services carried out until the date of cancellation, and the Customer shall pay any due fees by the Customer in consideration of the said Services up to the cancellation date.

·          If the Customer cancels his/her subscription to the Al Ahly Net/ NBE Mobile service after receiving the Hard Token free of charge, he/she will bear the announced costs of the Hard Token.

Article (11): Correspondence and notices

·          Any notice, request or correspondence shall be sent to the Customer at his/ her address/ e-mail held with the Bank. All correspondence by the Bank shall be deemed delivered to the Customer once sent by normal, electronic mail or any specialized courier at the Customer’s last known address/e-mail to the Bank, which shall constitute evidence of notification. In case the Customer changes his/ her address/ e-mail held with the Bank, the Customer shall promptly notify the Bank of such change by a prior written notice.

Article (12): Miscellaneous

·          The Customer does hereby agree and undertake to comply with the terms and conditions of the electronic banking channels and services, as stated or amended currently or in the future, on the website of Al Ahly Net/ NBE Mobile. The Customer's utilization of the electronic banking channel or operation of the electronic banking service shall be deemed conclusive evidence establishing that the Customer has already reviewed and accepted the relevant terms and conditions without any objection thereto.

·          The Customer's signature/ electronic approval of subscription to Al Ahly Net/ NBE Mobile service and making use of its functions shall be deemed a full approval of the above-mentioned conditions and an undertaking of not breaching the same. These terms and conditions shall be supplementary and subject to the terms, conditions and agreements concluded and signed, or which will be concluded and signed, by the Customer with the Bank. Further, the Bank shall not be held liable for any loss, damage, costs or expenses, of whatever amount or under any name, incurred by the Customer due to any breach of these terms and conditions.

·          Any failed or delayed exercise by the Bank of any given right, authority or privilege shall not constitute a waiver of such right, authority or privilege or any part thereof. Further, the Bank's exercise of any right, authority or privilege shall not preclude any subsequent or further exercise thereof.

·          The Customer declares that all data and information stated in the subscription application to Al Ahly Net/ NBE Mobile services are correct, and shall bear any resulting responsibility if such data or information prove to be incorrect.

·          The Customer shall be liable for the correctness of the entered information, data and transactions that the Customer makes through the Bank's networks as the sole user of Al Ahly Net/ NBE Mobile services. The Customer further declares that the instructions, transactions and data entered shall be processed without further check by the Bank, without obtaining and/or reviewing written advices. The Bank shall not be liable in any way towards the Customer if any erroneous data are entered in the Bank's network.

·          The Customer declares that if the Bank sends the Customer's statements of account through any electronic means at the Customer's request, the Customer shall be liable for maintaining confidentiality of such statements, and the Bank shall not be liable for leaking such statements. The Bank shall not be liable for the failure of delivering such statements of account to the Customer due to reasons beyond the Bank's control and the Customer shall not be entitled to claim any indemnities against the same.

·          The Bank reserves the right to decline any application of subscribing to Al Ahly Net/ NBE Mobile services submitted by the Customer. The Bank further has the right to reject any instructions, inquiries, dealings and/or transactions received from the Customer while using Al Ahly Net/ NBE Mobile services with notifying the Customer if possible.

·          The Bank shall have the right, at anytime at its sole discretion, to suspend and/or restrict the Customer’s use of any of Al Ahly Net/ NBE Mobile services with notifying the Customer if possible.

·          The Customer undertakes that all transactions carried out via Al Ahly Net/ NBE Mobile services shall be legitimate, used for legitimate purposes, and made with unbanned persons and that the Customer is the real beneficiary of the service.

·        The Customer authorizes the Bank to send alerts, advertisements, publicity materials, and marketing campaigns related to the new products using any electronic means, including but not limited to the internet, e-mail, SMS and mailbox services, and agrees not to consider this a violation of his/ her privacy.

·          The Customer authorizes NBE to use/ disclose the Customer's data at the absolute discretion of the Bank to any third party.

·          The Bank shall not be liable for failure to execute any of the system-requested transactions due to any circumstance beyond the Bank's control. The Bank shall not accept any amendment or cancellation of the instructions or transactions previously sent by the Customer using Al Ahly Net online/ mobile phone services which have been executed.

·          Though the Bank uses all possible technological and security solutions to safeguard the Customer and Al Ahly Net/ NBE Mobile services against cyber risks and information crimes, the Bank shall not be liable for any damage that may be suffered by the Customer due to the risks of using the internet. The Customer shall be solely responsible for all risks related to using Al Ahly Net/ NBE Mobile services under this application as long as no violation or negligence has been committed by the Bank.

·          The Customer shall be solely responsible for the use of any software and/or hardware which jeopardizes the security and efficiency of the use of Al Ahly Net/ NBE Mobile services, resulting in the disclosure of the Customer's data, and the Customer shall be solely responsible for all consequences arising therefrom and shall discharge the Bank from any liability in this respect.

·          The Customer bears the responsibility for ensuring that his/her mobile phone used in carrying out payment transactions via Al Ahly Net/ NBE Mobile services is not compromised (jailbroken or rooted).

·          The Customer shall indemnify the Bank against any losses or damages of whatever type which the Bank may incur due to the Customer's violation of any provision of this application.

·          The Bank shall execute all instructions related to the Service subject hereof as received through the electronic banking services (including the internet and/or mobile phone) from the Customer to be processed on the accounts and shall answer any inquiry posted by the Customer through the electronic banking services. The Bank shall further post to the Customer's accounts any financial transactions linked to the above-mentioned services. The Customer's signature on these terms and conditions shall be deemed a declaration on his/her part that s/he is aware of the limitations of the use of electronic banking services and that the continuing and uninterruptible service depends on the use of technology and the limitations thereof. Consequently, the Customer hereby releases the Bank from any responsibility if the Customer fails to use the service for any reason beyond the Bank's control.

·          The Bank’s records shall be conclusive and legally binding evidence as to the validity of transactions and instructions.

·          The Bank constantly develops its services, and reserves its right to provide these services to be announced under the terms and conditions of using the service, and at the fees to be announced (if any) to the customers, given that the Customer's electronic approval of such terms and conditions shall be an integral part of this Application.

·        Please do not share your device PIN with anyone so that s/he may not enable any method of biometric authentication on your device and use it to log into your NBE Mobile account.

·        Upon logging into NBE Mobile using a biometric authentication method, you will be able to login using biometric authentication only and without having to enter your User ID.

·        You can disable logging into NBE Mobile using biometric authentication methods from the Application's settings.

·        In case of logging into NBE Mobile using a device that supports biometric authentication, login will be enabled using any enabled method(s).

·        In case your device enables more than one method of biometric authentication, you can login into NBE Mobile using any method that will be enabled.

·        The Bank shall not be responsible for using any method of biometric authentication by the customer in NBE Mobile login. The Customer shall be fully responsible for protecting his/her mobile phone/tablet/NBE Mobile Application/mobile phone PIN/login password.

·        Biometric authentication methods for NBE Mobile login can be disabled from the Application settings and not from the settings of the device used.

·        Devices which support enabling biometric authentication methods are devices running Android 9 and later versions and IOS 11 and later versions.

·        In case more than one method of biometric authentication is supported by your device, you can login into NBE Mobile using any enabled method.

 

Article (13): Changes and amendments

·          The Bank has the right to amend these terms and conditions wholly or partially, whether mentioned online or via the mobile phone. The Bank shall notify the Customer of any amendment by any means the Bank deems appropriate. The Customer shall accept these amendments to continue using the service. Such amendments made by the Bank to these terms and conditions shall be deemed an integral part hereof. The Customer shall read the warnings and alerts sent by the Bank. The Customer's ongoing use of the amended Al Ahly Net and NBE Mobile services shall be deemed an acceptance and approval by the Customer of such amendments.

Article (14): Applicable law and jurisdiction

·          These terms and conditions shall be subject to the laws and relevant executive regulations of the Arab Republic of Egypt, as well as the regulatory instructions and rules. Any dispute that may arise out of the construction, interpretation or implementation thereof shall be settled by the courts of Cairo of different types and instances or any other court selected by the Bank in this regard.

·          In case of discrepancy between the Arabic and English versions, the Arabic version shall prevail.

Article (15): Banking consumer protection

NBE is keen on implementing the best international standards applicable in the banking system, and establishing obvious rules and principles governing the relationship between the Bank and its Customers at all stages of the transaction to achieve the best standards of fairness and transparency, comply with CBE's controls and protect customers' data and rights in a manner that instills confidence between the Bank and its Customers based on clear rules and principles. To this end, the following is agreed:

·          Without prejudice to the Law of the Central Bank and Banking Sector on the confidentiality of customers' accounts and the AML/CFT Law and regulations, the Bank undertakes to protect the data and information of Customers as all the financial and personal data and information of the Customers shall be confidential and may not be used or shared with third parties by the Bank without obtaining the Customer's prior written consent.

·          The Bank publishes the tariffs of banking services as amended on the Bank's official website: www.nbe.com.eg for Customer's information.

·          All correspondence between the Parties hereto shall be in Arabic.

·          The Customer shall have the right to submit a complaint to the Complaints Department at NBE or to any NBE branch, or register the same by any other means provided or introduced by the Bank. The Bank shall reply to the complaint (in writing or electronically) within 15 business days from the date of complaint receipt, except for the complaints related to transactions with foreign entities (the Customer will be notified of the period required to consider the complaint). In case the Customer rejects the Bank's reply, s/he shall notify the Bank of the reasons for rejection in writing within 15 business days from the date of receiving the Bank's reply. If the Customer fails to do so, this shall be deemed an implicit acceptance of the Bank's reply. In case the Bank is provided with the reasons for rejection, the complaint shall be reconsidered and the Customer shall be provided with the Bank's final reply within 15 business days. The Customer may not escalate any complaint in relation hereto to the CBE directly, except in the following two cases:

·        Bank's failure to reply to the complaint submitted by the Customer within 15 business days from the date of receiving the same by NBE. and

·        Customer's rejection of the Bank's final reply to the compliant.

·          The Customer has carefully read all terms and conditions contemplated hereunder, and understood their content clearly and precisely.

·          The Customer shall have the right to peruse the service application form prior to subscription, and receive a copy thereof at anytime subsequent to subscription.

·          The Customer shall not offend the Bank or its staff, representatives, agents, or correspondent banks nor take any procedure or action that would harm the Bank and its reputation, whether inside or outside NBE premises and branches, by any electronic means or via social media. If the Customer violates the aforementioned, the Bank shall have the right, not only to close the account, but also take all the legal banking procedures for protecting its rights against the Customer.

Information privacy

The privacy policy is meant to help you understand our policy regarding personal information you provide us upon using this application and how National Bank of Egypt (NBE) uses and protects personal information in alignment with usual strict security and confidentiality standards pursuant to the relevant national laws and legislation.

What user data do we collect (type of collected data)

The information that we retain in relation to you usually comes directly from you (including without limitation information provided when you apply for a new product/service). Such information includes the following:

·         Personal information (for example: name, date of birth, nationality or other identification information)

·         Contact details (for example: addresses, telephone numbers or email address)

·         Transaction details (for example: payments received or made by you)

·         Financial information (for example: your bank account number, credit card or loan numbers or financial history) including information provided by you for the purpose of offering payment services and account information services with respect to accounts held by you with other service providers

·         Proof of income (for example: employer letters, payment cards or bank information) if you provide such information upon applying for a certain product

·         Information on your health and lifestyle to meet our regulatory obligations including lending obligations

·         Other information (for example: mortgage loan applications).

 

However, if you fail to provide us with any mandatory personal information (which you are obligated to provide), this means we may not be able to provide you with the service you are applying for or fulfill all our obligations towards you.

Who might we share your personal information with

We shall keep your information confidential, but we may share such information if we are required to do so according to applicable laws and legislation with:

·         Third parties, such as (insurers, service providers, credit agencies, correspondent banks in case of money transfers, etc.)

·         Official entities, such as (government agencies, authorities, judicial bodies, regulators, etc.)

 

Retaining your personal information

 We shall retain your personal information only as long as required based on business needs. We will only use such information to the extent necessary for us to be in compliance with our legal obligations, to resolve disputes and to enforce our agreements and legal policies.

Information privacy assurance and security

NBE shall maintain the security and confidentiality of your information. It shall exert its best efforts to protect your information using cutting-edge technology and software and implementing privacy policies to help protect all information collected through all NBE's service delivery channels.

Corporate - Terms and conditions of using Al Ahly Net and NBE Mobile services

Upon signing this application, the Customer can use Al Ahly Net and NBE Mobile services provided by the National Bank of Egypt (NBE) subject to the terms and conditions stated hereinafter as well as the terms and conditions indicated online/ via mobile phone. The provisions, terms and conditions of the account opening form, and the conditions of NBE's banking products used by the Customer, as amended, shall also remain in full force and effect with respect to all transactions and the Customer's relationship with the Bank.

Article (1): Definitions

The following words and expressions shall bear the meanings assigned to them hereinafter:

·          "Bank" means the National Bank of Egypt (NBE) S.A.E.

·          "Customer" means the legal person, either a company/ institution/ association/ organization/ correspondent bank, holding the account, and/or the person authorized by the Customer to sign any transactions with the Bank, whose data are stated in Al Ahly Net and NBE Mobile service application form.

·          "Confidential Data" means all the data related to activating and using Al Ahly Net and NBE Mobile services, including but not limited to user name, login password and/or Customer's data and accounts.

·          "Service maker" means an employee designated by the Customer to process all electronic banking services at the Customer's discretion.

·          "Checker" means the person authorized by the Customer to use all the electronic banking services under the financial authorities and powers vested to him/her.

·          "Service user" means the person authorized by the Customer to use all the electronic banking services under the legal documents and the respective financial authorities and powers vested to him/ her as a maker or checker.

·          "Hard token" is a device held by the Customer and used to generate one-time passwords (OTP).

·          "Biometric authentication" means the feature of logging into NBE Mobile App via mobile phones and tablet devices using fingerprint or facial recognition features.

·          "OTP" is a code generated through hard/ soft token or it is sent by NBE for one-time usage to verify the Customer's identity.

Article (2): Service provision mechanism

·          Al Ahly Net and NBE Mobile service enables the Customer to perform certain banking transactions electronically, including but not limited to purchasing/ redeeming/ amending certificates, booking/ canceling term deposits, perusing statements of account, making transfers across Customer's own accounts and to other accounts in local currency inside the Arab Republic of Egypt, in addition to the services to be provided by the Bank from time to time.

·          The Customer visits the nearest NBE branch to fill in the application form of Al Ahly Net and NBE Mobile corporate services, then the branch officer verifies the Customer's identity and ensures that the Customer is not banned from subscribing to the Service.

·          The Customer receives the corporate ID, user name via the registered e-mail of each user and the password via SMS to the registered mobile phone number of each user, and the hard token from the branch, after which the service is automatically activated by the branch. Upon accessing the Service for the first time, the Customer shall change the password and create and maintain a new password under its full responsibility.

·          The Customer may choose one or more service users who are classified as maker or checker in accordance with the financial authorities vested by the Customer in the application of subscribing to Al Ahly Net and NBE Mobil service. The Customer can add or block any user later by submitting an application for amending the service.

·          If the login password is lost, the user may reset the login password by taping "forgot password".

·          The Customer has the right to cancel the service at anytime, at its discretion, by visiting the nearest NBE branch.

Article (2/1): Subscription to execute financial transactions

·          In case of subscribing to the financial transactions service, the Customer receives a hard token device that generates a one-time password (OTP) to be used by the Customer in completing the financial transaction, noting that the steps of use are indicated by the service upon executing any financial transaction.

·          The hard token device is personal and may not be returned once received from the branch. The device can be reassigned to another user in the company as per the Customer's request.

·          Customer/ service user activates The hard token device directly from the service after being received from the branch.

·          Upon the first use of the device, the Customer creates a hard token PIN.

·          In case of losing the PIN or having the hard token locked due to repeated incorrect PIN entry, the Customer shall visit the nearest NBE branch.

·          In case the hard token device is lost, stolen or damaged after being received by the Customer/ service user, the Customer/ service user shall notify the Bank as soon as possible by visiting the nearest NBE branch. Accordingly, the Bank will deactivate the hard token device and shall be only held liable from the date of deactivation. If the Customer requests to receive a new device for any reason whatsoever, the applicable charges shall be collected.

Article (3): Financial transactions

·          The Customer may not make any financial transactions, instructions, operations and/or requests exceeding its account balance. If so, the Bank will promptly decline the financial transactions, instructions, operations or requests without any notification.

·          All financial transactions, instructions, operations or requests made by the Customer shall be executed using the exchange/ interest rates and mutual fund certificate prices prevailing and applicable at the Bank on the actual execution date and at the cutoff-time set by the Bank.

·          In case of placing standing instructions, the Customer shall have a sufficient balance to execute the standing instructions on the specified dates.

·          Fees and commissions applicable by the Bank on financial and non-financial transactions made via Al Ahly Net and NBE Mobile service shall be debited according to the banking tariff.

·          Customer's request shall not be executed in case there are insufficient funds in its account to complete the transfer to a beneficiary with NBE or with another bank on the execution date of transfer.

·          The Customer shall be held liable for all the transactions executed via the Service and the payment of any amounts due to the Bank resulting from that usage.

·          The Customer declares that it shall be solely liable for the correctness of data related to money transfers, including but not limited to beneficiary's name and account number, amount, bank and branch name, etc., without the least liability on the Bank.

·          The Customer shall comply with all the rules and regulations issued by the Central Bank of Egypt (CBE) regarding banking transfers.

·          The Bank shall have the right to change the daily or monthly maximum limit or amounts of financial transactions processed via Al Ahly Net and NBE Mobile service without notifying or referring to the Customer.

·          The Bank shall have the right to reject the financial transactions that exceed the daily or monthly maximum limit or amounts of financial transactions processed via Al Ahly Net and NBE Mobile service without notifying or referring to the Customer.

Article (4): Bill payment

·          The Customer shall keep sufficient account balance to pay any bills on their due dates. The Bank shall not be held liable for any non-payment of bills on their due dates because of insufficient balance in the Customer's account. The Customer shall be solely liable for any relevant interests and/or default interests resulting from any delayed payment.

·          The Customer declares that it shall be solely liable for the correctness of data related to the bill payment feature, including but not limited to phone number, amount, bill number, etc., without the least liability on the Bank. The Customer shall bear all the ensuing consequences as the Bank shall not verify the correctness of such data.

Article (5): Service charges

·          The Customer shall bear the charges (for subscription as well as banking commissions resulting from using different electronic services) as specified and announced by the Bank from time to time. In case the Customer subscribes to the service of financial transactions, the expenses of using the hard token shall be collected based on the number of users. The Bank reserves the right to amend such charges provided that the Customer is notified by such means deemed appropriate by the Bank. Thus, the Customer does hereby authorize the Bank to debit any due charges to the Customer's account(s) held with the Bank.

Article (6): Service availability

·          In case of service unavailability due to failure of the systems operated by the Bank or any specialized entities contracted by the Bank, the Bank shall undertake due diligence to restore the service within 4 hours. Otherwise, the Bank shall communicate with the Customers by such means as the Bank deems appropriate to inform them of the time by which the service is expected to be restored.

·          The Bank may, from time to time, amend, maintain and/or update Al Ahly Net and NBE Mobile services, which may require suspending the service for a certain period determined by the Bank. In such case, the Bank shall not be liable for the Customer's failure to use the electronic banking services and the Customer may not have recourse against the Bank for any claims during that period, noting that such amendments, update and/or maintenance shall be announced on the service website.

·          The Bank shall not be liable for any malfunction of Al Ahly Net and NBE Mobile services due to any reason/event beyond its control and without any violation or negligence on the Bank's part; neither shall the Bank shall be held liable for any malfunction of the means of communication, any computer virus and/or any related problem.

Article (7): Liabilities and obligations

·          The Bank shall maintain the confidentiality of all data and information received from the Customer in the course of providing Al Ahly Net and NBE Mobile services. The Bank shall keep confidential all the Customer's transactions made via the service. The Bank shall not disclose any of the above-mentioned data, information or transactions unless so required by the applicable laws of the Arab Republic of Egypt and/or in execution of any binding judgments or orders or subject to the terms and conditions of Al Ahly Net and NBE Mobile services.

·          The Customer/ service user declares that it accepts full and complete liability for maintaining confidential data and taking all necessary measures to maintain and not disclose such data to any unauthorized person, or an employee of the Bank or any other entity.

·          The Customer declares that it shall be solely responsible for protecting and using its mobile phone/ tablet devices in case of activating the "Biometric Authentication" feature to be used as a means of identity verification upon logging into NBE Mobile service.

·          The Customer and/ or service user declares that in case it becomes aware that any of its accounts was stolen, embezzled or manipulated, that unauthorized financial transactions were posted to its account(s), or that any other unauthorized person had access to its confidential data, the Customer shall promptly contact the Bank and request suspending Al Ahly Net and NBE Mobile services in order for the Bank to take the necessary measures. If the Customer fails to do so, it shall be held liable for any unauthorized transactions/ operations made on its account. Moreover, the Customer shall be liable for all instructions executed by the Bank, resulting from a request or inquiry made by any person unauthorized to use its confidential data. The Bank shall not be held liable for any claim, loss, delay charges or expenses resulting from such instructions.

·          If the Customer's/ service user's mobile phone is lost or stolen, it shall promptly notify the Bank in order to suspend Al Ahly Net and NBE Mobile services.

·          The Customer/ service user declares that it shall be solely liable for safeguarding its mobile phone used for the service and the Bank shall not be held liable for disclosing any confidential data/ information sent to its mobile phone.

·          The Customer and/ or service user shall review the warnings and alerts published on the website of Al Ahly Net and NBE Mobile services, and comply with all the terms and conditions displayed on such website, which shall be deemed legally binding on the Customer.

·          The Customer and/ or service user shall review and comply with the security tips and instructions published on NBE's electronic channels or official website.

·          The Customer and/ or service user shall abide by all security standards as well as any other security instructions issued by the Bank. The Customer agrees to peruse and review such standards and instructions on a regular basis. The Customer shall be held liable for ensuring the security level of the devices used for accessing the Bank's electronic services.

·          The Customer and/ or service user expressly acknowledges hereunder the full authenticity of the Bank's system-generated printouts proving the banking instructions/ transactions made through the service by the Customer.

·          The Customer and/ or service user shall notify the Bank in writing promptly upon the occurrence of any change in the data related to its legal status or incompetence of a maker and/or checker. If the Customer fails to give such notification, it shall bear the full legal liability and the consequential damages. Moreover, banking transactions executed without notifying the Bank in writing shall be deemed valid, and the Customer shall solely be fully liable for such transactions.

·          The Customer and/or service user, whether a maker/ checker, shall use the services contemplated hereunder in legal transactions which neither conflict with the Egyptian laws nor prejudice the State's interests or national security of the Arab Republic of Egypt.

·          The Customer and/or service user shall update the subscribers' data, including but not limited to mobile phone number and/ or e-mail.

·          The Customer guarantees and/or the service user, whether a maker/ checker, declares, that the use of services contemplated hereunder shall not violate or breach the legal rights of any third party.

·          The Bank shall notify the Customer and/ or service user of any high-risk financial transactions or activities made through the account - unless the Customer and/ or service user requires otherwise - via SMS or e-mail.

Article (8): Disclaimer

·          Neither the Bank nor other specialized entities contracted by the Bank shall be held liable for any damages resulting from delay in sending/transferring the information, failure/error in receiving the information, loss of information, uncontrollable malfunction, emergencies (e.g. shortage, business interruption, strikes, force majeure, natural catastrophes, security gaps), measures taken by the State authorities, or any other events. The Bank shall not be liable for any damages to the Customer, technology or electronic equipment due to the occurrence of any of the foregoing events as long as there is no violation or negligence by the Bank.

·          The Bank shall undertake due diligence to provide Al Ahly Net and NBE Mobile services, and shall not be held liable for any failure in providing the service partially or wholly for any reason beyond the Bank's control. The Bank shall not provide any commitments or guarantees with respect to quality, speed, accuracy, etc. The Bank shall not guarantee that the programs are free of errors or deficiencies, and undertakes to handle any negative impacts on the banking operations resulting therefrom. The Customer declares that the Bank may not be held liable for the foregoing unless the Bank commits an act of violation or negligence.

 

·          The Customer and/ or service user declares that its mobile phone, user ID, corporate ID, login password, account number and the hard token device, if received from the Bank, and the login feature using a biometric authentication like facial recognition/ fingerprint, if activated by the Customer, are all means of identification of the Customer and that any transactions executed using such means shall be deemed to be executed by the Customer since such means shall constitute an electronic signature. The Bank shall consider any person using such means to be the Customer. The Customer shall be held liable for all transactions executed using its respective means of identification, as well as for any change, loss or transfer of any of such means of identification to a third party until such time when the Bank can suspend the service based on a request by the Customer. Since such services are provided online and/or via mobile phone, the Bank shall not be responsible for disclosing any confidential account information as a result of any misuse on the part of the Customer or the persons authorized by it or due to electronic hacking.

·          The Customer and/or service user declares to be solely responsible for keeping the confidentiality of OTP to be sent to the Customer's mobile phone or e-mail, or generated by the Hard Token upon performing Al Ahly Net and NBE Mobile services.

·          As for using Biometric Authentication including fingerprint or facial recognition features or any other means of Biometric Authentication, the Bank will activate them in the future to enable logging into the service via NBE Mobile, using all Biometric Authentication features defined on the mobile phone/ tablet device. The Customer shall bear full responsibility without the least liability on the Bank.

·          The Customer shall carefully read and approve Biometric Authentication Terms & Conditions before activating and using the biometric authentication features as a means to identify the Customer logging into NBE Mobile App. The Customer's electronic approval to activate the feature via the mobile phone/ tablet device, and use of its advantages, shall be deemed a full approval of the outlined terms and conditions and an undertaking not to breach such terms and conditions.

·          The Customer shall follow up the banking instructions/ transactions executed through Al Ahly Net/ NBE Mobile services according to the powers of service users. The Customer shall be fully liable for following up the banking instructions/ transactions.

·          The signatures of the Customer's signatories shall be deemed authorized for the purposes of all banking instructions/ transactions executed using Al Ahly Net/ NBE Mobile by the service users, and the Customer shall be fully liable therefor.

·          The Bank may add new electronic services or amend/cancel the existing services at its sole discretion, and shall notify the Customer by such means as the Bank deems appropriate.

·          In case of executing transactions by a maker/ checker, the Customer shall approve the purchases and redemptions of mutual fund certificates on the same date and within the Fund's business hours announced on the purchase and redemption screens.

Article (9): Copyright and intellectual property rights

·          NBE's logo is a trademark owned and registered by NBE. In general, NBE is the owner of any trademarks pertaining to its products/services.

·          The Customer and/ or service user agrees and acknowledges that it does not - and shall not - own any copyright or any other intellectual property rights (IPRs) as regards any of the programs, interfaces or documents provided by the Bank to offer or improve electronic banking services. The Customer may not, and shall not, allow users or third parties to, copy or amend any of such programs, interfaces or documents provided by the Bank; or upload or transfer the electronic banking service programs from/to any other computer, phone, tablet or similar electronic device. If the Customer fails to comply with the foregoing or to secure the programs and documents provided by the Bank as a service, the Bank may claim all necessary indemnities for the damages sustained by the Bank.

·          Copyright of images, graphics, information, marks, texts, publicity materials, interfaces and webpages, including design of the website pages, are the property of the Bank and/or any other party referred to in the website pages and may not be used for any personal or commercial purposes.

Article (10): Service termination

·          If the Customer wishes to suspend Al Ahly Net / NBE Mobile services, it shall visit the nearest NBE branch to fill in the service termination application form. If the Customer wishes to re-activate the service, it shall visit the nearest NBE branch to fill in the service re-activation application form affixed with the Customer's verified signature.

·          The Bank may terminate the Customer's subscription to the said services at anytime. Such termination shall not exempt the Customer from any obligations with respect to the electronic banking services carried out till the termination date, and the Customer shall pay any due fees because of using such services up to the termination date.

·          If the Customer terminates its subscription to the financial transaction service, it shall pay the announced due expenses of the hard token.

Article (11): Correspondence and notices

·          Any notice, request or correspondence shall be sent to the Customer at its address/ e-mail established in the Bank's records. All the Bank's correspondence shall be considered as delivered to the Customer once sent by ordinary or electronic mail or any specialized courier at the Customer's latest address/ e-mail held with the Bank, which shall constitute evidence of notification. In case the Customer changes its address/ e-mail held with the Bank, it shall notify the Bank of such change by a prior written notice.

Article (12): Miscellaneous

·          The Customer agrees and undertakes to comply with the terms and conditions of electronic banking channels and services, as stipulated or amended currently or in the future, on the website of Al Ahly Net/ NBE Mobile. The usage of the electronic banking channel or service by the Customer shall be conclusive evidence that the Customer has previously read and agreed to the relevant terms and conditions, without any objection thereto.

·          The Customer's and/ or service user's signature for subscribing to Al Ahly Net and NBE Mobile services and use of their advantages shall be deemed a full approval of the above-mentioned conditions and an undertaking not to breach such conditions. These terms and conditions shall be supplementary and subject to the terms and conditions or agreements concluded and signed, or which will be subsequently concluded, by the Customer with NBE. The Bank shall not be held liable for any loss, damage, costs or expenses, of whatsoever value or nature, incurred by the Customer due to breaching these terms and conditions.

·          No failure or delay to exercise any particular right, power or privilege by the Bank shall constitute a waiver of such right, power or privilege or any part thereof. Further, NBE's exercise of such right, power or privilege shall not preclude any subsequent or further exercise thereof.

·          The Customer declares that all data and information stated in the application form of Al Ahly Net and NBE Mobile services are correct, and shall be held liable if such data or information prove to be incorrect.

·          The Customer authorizes NBE to use/ disclose the Customer's data at the absolute discretion of the Bank to any third party.

·          The Customer and/ or service user shall be liable for the correctness of the information, data and transactions it makes or provides via the Bank's networks as the sole user of Al Ahly Net and NBE Mobile services. The Customer further declares that the instructions, transactions and data entered shall be processed without performing further check by the Bank, obtaining written advices and/or verifying the same. The Bank shall not be liable in any way towards the Customer if any erroneous data are entered into the Bank's network.

·          The Bank reserves the right to reject any application form submitted by the Customer to obtain Al Ahly Net and NBE Mobile services. Furthermore, the Bank reserves the right to reject implementing any instructions, inquiries, transactions and/or operations received from the Customer while using Al Ahly Net and NBE Mobile services.

·          The Bank may, at anytime at its absolute discretion, suspend and/or limit the Customer's use of any of Al Ahly Net and NBE Mobile services.

·          The Customer and/ or service user undertakes that all transactions carried out via Al Ahly Net and NBE Mobile services are legal, for legitimate purposes, and with unbanned persons and that the Customer is the real beneficiary of the services.

·          The Customer and/ or service user authorizes the Bank to send alerts, advertisements, publicity materials, and marketing campaigns related to the new products using any electronic channel, including but not limited to the internet, e-mail, SMS and mailbox services, and shall not deem this a violation of its privacy.

·          The Bank shall not be liable for failure to execute any of the transactions received via the system due to any reason beyond the Bank's control. Moreover, the Bank shall not be obliged to accept any amendments or cancel instructions or transactions previously sent by the Customer using Al Ahly Net and NBE Mobile services which were already executed.

·          Though the Bank uses all possible technological and security solutions to protect the Customer and Al Ahly Net and NBE Mobile services against cyber risks and information crimes, the Bank shall not be liable for any damage that may be suffered by the Customer due to the risks of using the internet. The Customer shall be solely responsible for the risks that may result from its use of Al Ahly Net and NBE Mobile services under this application form as long as there is no violation or negligence on the part of the Bank.

·          The Customer and/ or service user shall be solely responsible for the use of any software and/or hardware which may threaten the security and efficiency of using of Al Ahly Net and NBE Mobile services leading to the disclosure of the Customer's data. The Customer shall be solely responsible for all consequences arising therefrom and the Bank disclaims any responsibility in this respect.

·          The Customer and/ or service user shall be responsible for ensuring that its mobile phone used in carrying out payments via Al Ahly Net and NBE Mobile services is not compromised (jailbroken or rooted).

·          The Customer and/ or service user shall indemnify the Bank against any type of losses or damages which the Bank may incur due to the Customer's breach of any of the provisions contemplated hereunder.

·          The Bank shall execute all instructions related to the service subject hereof which are received via electronic banking services (including the internet and/or mobile phone) from the Customer to operate the accounts, and shall answer any inquiry made by the Customer through the electronic banking services. The Bank shall further post to the Customer's accounts any financial transactions executed through the above-mentioned services. The Customer's signature on these terms and conditions shall be deemed a declaration on its part that it is aware of the limitations imposed on the use of electronic banking services and that the continuous uninterrupted provision of electronic banking services depends on the employed technology and such limitations. Consequently, the Customer hereby releases the Bank from any liability should the Customer be unable to use the service for any reason beyond the Bank's control.

·          The Bank's books and records shall constitute legally binding and conclusive evidence of the validity of the transactions and instructions.

·          The Bank constantly develops its services and reserves its rights to provide such services under terms and conditions as well as charges (if any) to be announced to the Customers, and the Customer's electronic approval of such terms and conditions shall be an integral part hereof.

·          In case of using biometric authentication such as touch ID or face ID or any other method of biometric authentication which shall be made available in the future by the Bank to log into NBE Mobile, you can login using any method of biometric authentication enabled on the mobile phone or tablet which supports its usage. The Customer shall be fully liable for the usage of such method without any liability on the Bank.

·          Please do not share your device PIN with anyone so that s/he may not enable any method of biometric authentication on your device and use it to log into your NBE Mobile account.

·          Upon logging into NBE Mobile using a biometric authentication method, you will be able to login using biometric authentication only and without having to enter your User ID.

·          You can disable logging into NBE Mobile using biometric authentication methods from the Application's settings.

·          In case of logging into NBE Mobile using a device that supports biometric authentication, login will be enabled using any enabled method(s).

·          In case your device enables more than one method of biometric authentication, you can login into NBE Mobile using any method that will be enabled.

·          The Bank shall not be responsible for using any method of biometric authentication by the customer in NBE Mobile login. The Customer shall be fully responsible for protecting his/her mobile phone/tablet/NBE Mobile Application/mobile phone PIN/login password.

·          Biometric authentication methods for NBE Mobile login can be disabled from the Application settings and not from the settings of the device used.

·          Devices which support enabling biometric authentication methods are devices running Android 9 and later versions and IOS 11 and later versions.

·          In case more than one method of biometric authentication is supported by your device, you can login into NBE Mobile using any enabled method.

 

 

Article (13): Changes and amendments

·          The Bank may amend these terms and conditions wholly or partially, including the terms and conditions indicated online or via mobile phone in respect of the service. The Bank shall notify the Customer of any amendment, via any means deemed appropriate by the Bank. The Customer shall accept these amendments to continue using the service. Such amendments made by the Bank to these terms and conditions shall be deemed an integral part thereof. The Customer shall read the warnings and alerts sent by the Bank. The Customer's ongoing use of the amended Al Ahly Net and NBE Mobile services shall be deemed an acceptance and approval by the Customer of such amendments.

Article (14): Applicable law and jurisdiction

·          All terms and conditions herein shall be governed by the provisions of the laws of the Arab Republic of Egypt and the relevant executive regulations as well as the regulatory instructions and rules. Any dispute arising in relation to the construction, interpretation or execution thereof shall be settled by Cairo courts of different types and instances or any other court selected by the Bank.

·          In case of discrepancy between the Arabic and English versions, the Arabic version shall prevail.

Article (15): Banking consumer protection

NBE is keen on implementing the best international standards applicable in the banking system, and establishing clear rules and principles governing the relationship between the Bank and its Customers at all stages of the transaction to achieve the best standards of fairness and transparency, comply with CBE's controls and protect customers' data and rights in a manner that instills confidence between the Bank and its Customers based on obvious rules and principles. To this end, the following was agreed:

·          Without prejudice to the Law of the Central Bank & Banking Sector on the confidentiality of customers' accounts and the AML/CFT Law and regulations, the Bank undertakes to protect the data and information of Customers as all the financial and personal data and information of the Customers shall be confidential and may not be used or shared with third parties by the Bank without obtaining the Customer's prior written consent.

·          The Bank publishes the tariffs of banking services as amended on the Bank's official website: www.nbe.com.eg for Customer's information.

·          All correspondence between the Parties hereto shall be in Arabic.

·          The Customer shall have the right to submit a complaint to the Complaints Department at NBE or to any NBE branch, or register the same by any other means provided or introduced by the Bank. The Bank shall reply to the complaint (in writing or electronic form) within 15 business days from the date of complaint receipt, except for the complaints related to transactions with external entities (the Customer will be notified of the period required to consider the complaint). In case the Customer rejects the Bank's reply, it shall notify the Bank of the reasons for rejection in writing within 15 business days from the date of receiving the Bank's reply. If the Customer fails to do so, this shall be deemed an implicit acceptance of the Bank's reply. In case the Bank is provided with the reasons for rejection, the complaint shall be reconsidered and the Customer shall be provided with the Bank's final reply within 15 business days. The Customer may not escalate any complaint in relation hereto to the CBE directly, except in the following two cases:

·        The Bank's failure to reply to the complaint submitted by the Customer within 15 business days from the date of receiving the same by NBE.

·        The Customer's rejection of the Bank's final reply to the compliant.

·          The Customer has carefully read all terms and conditions contemplated hereunder, and understood their content clearly and precisely.

·          The Customer shall have the right to peruse the service application form prior to subscription, and receive a copy thereof at anytime subsequent to subscription.

·          The Customer shall not offend the Bank or its staff, representatives, agents, or correspondent banks nor take any procedure or action that would harm the Bank and its reputation, whether inside or outside NBE premises and branches, by any electronic means or via social media. If the Customer violates the aforementioned, the Bank shall have the right, not only to close the account, but also take all the legal banking producers for protecting its rights against the Customer.

Information privacy

The privacy policy is meant to help you understand our policy regarding personal information you provide us upon using this application and how National Bank of Egypt (NBE) uses and protects personal information in alignment with usual strict security and confidentiality standards pursuant to the relevant national laws and legislation.

What user data do we collect (type of collected data)

The information that we retain in relation to you usually comes directly from you (including without limitation information provided when you apply for a new product/service). Such information includes the following:

·         Personal information (for example: name, date of birth, nationality or other identification information)

·         Contact details (for example: addresses, telephone numbers or email address)

·         Transaction details (for example: payments received or made by you)

·         Financial information (for example: your bank account number, credit card or loan numbers or financial history) including information provided by you for the purpose of offering payment services and account information services with respect to accounts held by you with other service providers

·         Proof of income (for example: employer letters, payment cards or bank information) if you provide such information upon applying for a certain product

·         Information on your health and lifestyle to meet our regulatory obligations including lending obligations

·         Other information (for example: mortgage loan applications).

 

However, if you fail to provide us with any mandatory personal information (which you are obligated to provide), this means we may not be able to provide you with the service you are applying for or fulfill all our obligations towards you.

Who might we share your personal information with

We shall keep your information confidential, but we may share such information if we are required to do so according to applicable laws and legislation with:

·         Third parties, such as (insurers, service providers, credit agencies, correspondent banks in case of money transfers, etc.)

·         Official entities, such as (government agencies, authorities, judicial bodies, regulators, etc.)

 

Retaining your personal information

We shall retain your personal information only as long as required based on business needs. We will only use such information to the extent necessary for us to be in compliance with our legal obligations, to resolve disputes and to enforce our agreements and legal policies.

Information privacy assurance and security

NBE shall maintain the security and confidentiality of your information. It shall exert its best efforts to protect your information using cutting-edge technology and software and implementing privacy policies to help protect all information collected through all NBE's service delivery channels.
